Terms of service

Welcome to kimjie.com and any other site that links to these terms (together, the “Site”), operated by kimjie (“kimjie”, “we”, “us”, “our”). Except where stated otherwise below, these terms and conditions (the “Terms”) govern your use of the Site and of our services, applications and content, and your purchase, receipt or use of the cosmetic products we make available through it (the “Products”).
PLEASE READ THESE TERMS CAREFULLY. YOUR USE OF THE SITE OR YOUR PURCHASE OF PRODUCTS IS YOUR AGREEMENT TO FOLLOW AND BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SITE AND DO NOT PURCHASE, RECEIVE OR USE OUR PRODUCTS.
We may change or modify these Terms at any time. If we make a material change we will post the revised Terms here with a new effective date and, where we hold your email address, tell you. By continuing to use the Site after that notice you accept the revised Terms and everything incorporated into them by reference. We encourage you to read them from time to time so that you know which terms apply when you use the Site or order a Product. If you do not agree to a revised version you are free to reject it, but in that case you may not continue to use the Site or order Products.
1. Who we are, and how to reach us
kimjie sells korean skincare directly to the people who use it. We are established in the Netherlands and we ship to the countries listed in our Shipping Policy.
The fastest way to reach us about anything in these Terms — an order, a return, a legal notice, a complaint — is hello@kimjie.com. A person reads it.
2. Eligibility, accounts and your details
You may use the Site only if you are able to form a binding contract with us, and only in compliance with these Terms and with all applicable local, national and international law. You must be at least 18 years old to place an order, or have the permission of a parent or legal guardian.
You can order as a guest or create an account. If you create one, you must give complete and accurate information about yourself, and you have a continuing obligation to update that information when it changes. You will be asked to set a password. You agree that you will not share your login details with anyone, for any reason; that you and no one else will use your account; that you will contact us at hello@kimjie.com as soon as you become aware of unauthorised access to it; and that you will not create more than one account. You are responsible for the activity that takes place under your account, except where that activity results from our own failure.
We handle the information you give us in the way set out in our Privacy Policy, which is incorporated into these Terms by reference. By registering you consent to entering into agreements with us electronically. Paying for the connectivity and data plan of the device you use is your own responsibility, and we are not responsible for the availability of the internet or of any telecommunication service you need in order to reach the Site.
3. Terms of sale
3.1 Orders, pricing and payment
Everything shown on the Site is an invitation to order and not an offer. A contract between us is formed only when we send you an order confirmation. Until that moment we may refuse or cancel an order at our discretion — for example where a Product is out of stock, where a price or a description was wrong, or where we suspect fraud or a breach of these Terms. If we change or cancel an order we will try to reach you at the email address or phone number given when the order was placed.
We work to describe and price everything accurately, but we are not responsible for typographical, pricing or other errors. The colours you see depend on your screen, and we cannot guarantee that your screen shows the Product's true colour. Products shown may be out of stock or discontinued, and prices may change. Prices are displayed in US dollars; the price that applies to your order is the one shown at checkout. Unless we agree otherwise, payment must be received before we accept an order, and we may ship parts of an order separately.
3.2 Quantity limits
We may, at our discretion, limit the quantity of a Product bought per person, per household or per order. Those limits may be applied to orders placed on the same account, with the same payment card, or to the same billing or shipping address. Some orders are simply improper use of the Site, and we reserve the right to refuse or cancel any order, and to restrict or close an account, where we reasonably believe that to be the case.
3.3 No resale
Products are sold for personal use. A reseller, for the purposes of these Terms, is anyone who buys a Product from the Site in order to sell that same Product on to someone else. We may refuse to sell to resellers. Products you buy may not be resold, leased or transferred, and may not be exported to any country, person or end use restricted under applicable export control or sanctions law.
3.4 Shipping
You agree to pay the shipping charges shown at the time you order. We may change those charges from time to time, but the charge that applies to you is always the one shown before you pay. Delivery estimates, carriers and regions are set out in our Shipping Policy.
3.5 Taxes and duties
We collect sales tax, VAT or equivalent where we are required to do so for the destination. The amount shown at checkout may be adjusted where tax rates change or where a payment processor calculates differently. Unless you give us a valid tax exemption certificate that applies both to your purchase and to the delivery address, you are responsible for the sales and other taxes associated with your order.
Where import duties, customs charges or taxes are not collected at checkout, they are charged by the carrier or by the authorities on delivery and are your responsibility in addition to the shipping cost. We cannot predict or control them, because they are set by the destination country. Refusing a parcel in order to avoid them means the parcel comes back to us, and any charge we incur is deducted from your refund.
3.6 Returns and exchanges
See our Refund Policy, which also explains the statutory right of withdrawal that applies if you live in the European Union or the United Kingdom. Nothing in these Terms limits that right.
4. Subscriptions
Some Products can be bought on a recurring basis. If you start a subscription you authorise us to charge your payment method for each delivery, at the interval and quantity you selected, at the price shown when each order is placed, until you cancel. We will tell you before a renewal is charged and before any change to the price of a subscription.
You can skip, pause, change or cancel a subscription at any time from your account or by writing to hello@kimjie.com. A cancellation takes effect for any order that has not been processed yet; an order that has already shipped falls under the Refund Policy. If a renewal payment fails we may retry it, and if it keeps failing we may pause or cancel the subscription. Cancelling a subscription does not close your account, and closing your account does not by itself cancel a subscription — tell us if you want both.
5. The Products are cosmetics, not medicines
Our Products are cosmetics. Use each of them strictly in accordance with the instructions, precautions and guidelines on its packaging. Read the ingredient list before use if you have a known sensitivity or allergy, and patch test on the inside of the arm if you are unsure. If you have a skin condition, are pregnant or breastfeeding, or are under a doctor's care, ask a qualified professional before you use them.
Nothing on the Site is medical advice, and nothing on it is intended to diagnose, treat, cure or prevent any disease. The Site is a shop, not a substitute for professional advice. Any question or decision about a medical condition belongs with your own physician or health care practitioner. We do not answer medical questions and we do not present ourselves as qualified to. No prescription medicine or medical treatment is offered here.
IF YOU NEED MEDICAL ATTENTION, CONTACT YOUR LOCAL EMERGENCY NUMBER OR YOUR DOCTOR IMMEDIATELY.
If you have a reaction to a Product, stop using it, seek advice, and tell us at hello@kimjie.com — we are required to record it and we want to know.
6. International orders
Delivery takes place, and risk of loss and title in the Products pass to you, when the Products are delivered to you by the carrier. As the buyer you authorise us to arrange carriage on your behalf and to hand the Products to a carrier for delivery to you.
Orders shipped outside the country of dispatch may be subject to import duties and taxes as described in clause 3.5. Some Products may not be available in every region, and we do not claim that the information on the Site is appropriate to every jurisdiction. Where a Product cannot lawfully be sold or shipped to your address, we will cancel that part of the order and refund it.
7. Security
Violations of system or network security may lead to civil or criminal liability. We investigate them and may involve and cooperate with law enforcement. You must not violate or attempt to violate the security of the Site, including by: (i) accessing data that is not intended for you, or logging into an account or a server that you are not authorised to use; (ii) probing, scanning or testing the vulnerability of a system or network, or breaching a security or authentication measure, without our permission; (iii) interfering with the operation of the Site, with our service to any other visitor, or with our hosting provider or network, including by submitting a virus, overloading, flooding or crashing it; or (iv) forging any packet header or any part of the header information in any email or transmission sent to the Site.
8. What you may and may not do here
The Site may be used only for lawful purposes, and is available for your personal, non-commercial use — which means viewing it, buying Products, giving us information and downloading product information for your own reference. You are responsible for what you send, post or upload, and for the consequences. We specifically prohibit, and you agree not to use the Site for, any of the following:
- posting information that is incomplete, false, inaccurate, or not your own;
- conduct that would be a criminal offence, give rise to civil liability, or break any local, national or international law or regulation;
- transmitting or posting material that is copyrighted or otherwise owned by someone else, unless you own it or have the owner's irrevocable permission;
- transmitting or posting material that reveals a trade secret you do not own, that infringes anyone's intellectual property, privacy or publicity rights, or that otherwise breaks the law;
- transferring information or software obtained from the Site in breach of any applicable export control law; or
- interfering with the Site's networks or security, or using the Site to gain unauthorised access to any other system.
No material from the Site may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way except as specifically permitted here. We may revise the Products and services described on the Site, and may terminate, change, suspend or discontinue any part of it — including its content, its features and its hours of availability — at any time and without notice, and we are not liable to you or to anyone else for doing so. We may also set rules and limits on the use of the Site, or restrict access to part or all of it, and we may change those rules at any time.
9. Our intellectual property
As between you and us, kimjie owns or is the authorised user of every registered and unregistered trade mark, trade name and service mark appearing on the Site, and owns or licenses the material and content on it. The Site and everything in it — text, data, icons, artwork, photographs, illustrations, graphics, sound, software and the code used to generate the pages (together, the “Materials and Content”) — is protected by copyright, trade mark and other laws.
The name kimjie, the ㅎ mark, our logotype, our packaging design and the phrases and product names we use are ours and may be registered. You agree not to display or use them in any way without our written permission. Nothing on the Site should be read as granting a licence or right to use any of it. We grant you a personal, limited, non-exclusive, non-transferable licence to access the Site and use the information on it for your own non-commercial purposes as described here. Beyond that you may not modify, rent, lease, loan, sell, distribute or create derivative works from the Materials and Content, in whole or in part, and any commercial use of the Site is prohibited unless we approve it in writing.
10. Content you send us
We do not claim ownership of what you make. Any photograph, image, video, sound, text, review, comment, question, suggestion, idea or other material that you (i) submit or post on the Site or send us through any tool we provide, or (ii) post on your own social media accounts with a hashtag we promote (together, “User Content”) is treated as non-confidential and non-proprietary.
By submitting or posting User Content you grant kimjie a non-exclusive, royalty-free, worldwide, transferable and sublicensable licence to copy, publish, translate, adapt, reformat, distribute, display, store and otherwise use all or part of that User Content, together with the name, handle or likeness attached to it, in any medium, for the purposes of running, marketing and promoting kimjie. That licence lasts for as long as we are using the content and for a reasonable period afterwards; if you ask us to stop using a specific piece of User Content, write to hello@kimjie.com and we will remove it from anything we control within a reasonable time. You keep every other right you have in your User Content. Unless we have agreed something else with you in writing beforehand, no payment is due for this use, and you have no right to review or approve the way it appears.
By submitting or posting User Content you confirm that: you own or control the rights in it and may grant the licence above; anyone who appears in it has agreed to that use, and where a child appears you are their legal guardian and give that permission on their behalf; you are 18 or older; and the User Content is not false or misleading, does not infringe anyone's rights, is not defamatory, obscene, threatening, harassing or hateful, does not contain anyone's personal contact details, and does not contain viruses or harmful code. We may ask you for documentation or a release to verify this. You are responsible for your User Content and you agree to hold us harmless from claims and reasonable costs arising from a breach of this clause.
We do not guarantee the accuracy of User Content and we do not endorse the opinions in it. We are not obliged to monitor, publish or respond to it, we may remove or refuse to publish any of it at our discretion, and we are not responsible for storing it — keep your own copies. Where we become aware of User Content that may not meet these Terms we may investigate and decide what to do about it.
11. Competitions and promotions
From time to time we may run a competition, giveaway or other promotion. Each one has its own rules, which are published with it and which you must accept before entering. Entering is voluntary. Where we ask for personal information in order to run one, we use it only for that purpose and in the way our Privacy Policy describes, and where a third party runs it on our behalf they are prohibited from using it for anything else.
12. Copyright complaints and takedown
If you believe that something on the Site infringes your copyright, write to hello@kimjie.com with “Copyright notice” in the subject line and include: a physical or electronic signature of the rights holder or someone authorised to act for them; identification of the work you say has been infringed; identification of the material you say is infringing and enough information for us to find it; your contact details; a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law; and a statement that the information in the notice is accurate and that you are authorised to act. We remove material that is properly notified, we tell the person who posted it, and we accept counter-notices at the same address. We end the accounts of repeat infringers where that is appropriate.
13. Privacy
Whatever else these Terms say, our use of the personal information you give us through the Site is governed by our Privacy Policy. Please read it.
14. Links to other sites
The Site may link to websites, applications, products or services operated by other companies. We do not endorse, monitor or control them, they have their own terms and privacy policies, and you use them at your own risk. We are not responsible for their content, their availability or their practices, and we make no representation about the accuracy or safety of anything on them. It is your responsibility to read their policies.
15. Emails and text messages
If you give us your email address or phone number and agree to marketing, we may send you messages about kimjie — new products, restocks, occasional offers, and reminders about a basket you left behind.
- Opting in. You join by ticking the box at checkout, filling in a sign-up form, or replying to a keyword we publish. Consent to marketing is never a condition of buying anything.
- Opting out. Use the unsubscribe link in any email, reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to any text message, or write to hello@kimjie.com. You may get one more message confirming that you are out. Automated systems only recognise the words above, so please use one of them rather than a sentence.
- Cost and frequency. Message and data rates may apply. Frequency varies and depends on what you do on the Site.
- Help. Reply HELP to any text message, or write to hello@kimjie.com. That address is for help; it is not a way to opt out.
- Availability. Messaging is offered as-is. Delivery depends on your network operator and is outside our control, and we are not liable for a message that arrives late or not at all.
- Age. You must be 18 or older to sign up for marketing messages.
Withdrawing consent to marketing does not stop transactional messages about an order you have placed — confirmations, shipping notices and delivery updates.
16. Availability of the Site and disclaimers
We publish information on the Site for the convenience of the people who visit it. We work to keep it accurate and current, but there may be inadvertent technical or factual inaccuracies and typographical errors, and we may correct or change anything on the Site at any time without notice.
THE SITE AND THE PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, ABOUT THE SITE AND ITS CONTENT, INCLUDING ANY WARRANTY OF AVAILABILITY, ACCURACY, COMPLETENESS, USEFULNESS, TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SITE WILL BE TIMELY, SECURE, UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. NO ADVICE OR INFORMATION OBTAINED THROUGH THE SITE CREATES ANY WARRANTY NOT EXPRESSLY MADE HERE. IF YOU ARE DISSATISFIED WITH THE SITE, YOUR REMEDY IS TO STOP USING IT.
This clause does not limit anything that cannot lawfully be limited, and if you are a consumer it does not affect your statutory rights, including your right to receive Products that match their description and are of satisfactory quality.
17. Our liability
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for defective products under applicable product liability law, or for anything else that cannot lawfully be limited or excluded.
SUBJECT TO THE PARAGRAPH ABOVE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE LOSS, FOR LOSS OF PROFIT, REVENUE, BUSINESS, DATA OR GOODWILL, ARISING OUT OF OR CONNECTED WITH THE USE OF, OR THE INABILITY TO USE, THE SITE OR ANY PRODUCT, EVEN IF WE HAVE BEEN TOLD THAT SUCH LOSS WAS POSSIBLE. OUR TOTAL LIABILITY ARISING OUT OF OR CONNECTED WITH AN ORDER IS LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCTS IN THAT ORDER, AND OUR TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE OTHERWISE IS LIMITED TO ONE HUNDRED US DOLLARS.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this clause may not apply to you.
18. Indemnity
If you use the Site other than as a consumer, you agree to indemnify kimjie against claims, liabilities, damages and reasonable costs, including legal fees, arising from or connected with your use of the Site, your breach of these Terms, or material you posted or transmitted through the Site — including any claim by a third party that something you provided infringes their rights.
19. Force majeure
We are not liable for a delay or failure to perform that is caused by something outside our reasonable control, including strikes, carrier failures, customs delays, epidemics, extreme weather, fire, flood, war, civil unrest, failure of a utility or telecommunications network, or an act of government. Where such an event lasts long enough to make an order pointless, either of us may cancel it and we will refund what you paid.
20. Suspension and termination
We may suspend or close your account, or refuse to sell to you, where you breach these Terms, where we are required to by law, or where we reasonably suspect fraud. You may close your account at any time by writing to hello@kimjie.com. Clauses that by their nature are meant to survive — intellectual property, User Content, disclaimers, liability, indemnity and governing law — survive the end of this agreement.
21. Governing law and disputes
These Terms, any sale under them, and any claim or dispute between you and kimjie arising from or relating to them, to their interpretation, breach, termination or validity, to our advertising or to any purchase, are governed by the law of the Netherlands.
If you are a consumer resident in another country, you keep the protection of any mandatory consumer law of your country of residence, and nothing here removes your right to bring proceedings in the courts of that country. Otherwise the courts of the Netherlands have jurisdiction.
Please write to hello@kimjie.com before anything else — almost everything is settled that way. Consumers in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
22. General
If a provision of these Terms is found to be invalid or unenforceable, it is limited or removed to the smallest extent necessary and the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights or obligations under these Terms without our written consent; we may transfer ours to a company that takes over our business, and your rights are not reduced by that. These Terms, together with the Privacy Policy, the Refund Policy and the Shipping Policy, are the entire agreement between us about the Site and your order, and replace anything said before.
